Fife man seized his wife by the neck and assaulted son in early morning incident

A Kelty man assaulted his wife and her son during an early morning incident at their home, a court has been told.

Kevin Banks, 36, now of Lansbury Street, Kirkcaldy, appeared at Dunfermline Sheriff Court.

He admitted that on March 12 at his former home at Beechbank Crescent, Kelty, he assaulted his wife Ashley Banks by seizing her by the neck, raised his clenched his fist at her and held her down on a sofa.

He also admitted he assaulted 18-year-old Blair Aitchison by punching him on the head to his injury.

Depute fiscal Katherine Fraser said the incident began when Mrs Banks tried to wake up the accused who was sleeping on the sofa at around 7.30am.

“He jumped up and became angry and agitated,” added the depute.

The fiscal explained that Banks had then grabbed hold of her, raised his clenched fist and is said to have said: “There’s no witness now.”

Ms Fraser added that the second victim came into the room and was struck on the face during a struggle.

Defence solicitor Elaine Buist said the couple’s relationship was now at an end.

Sheriff Keith O’Mahony told Banks: “This was clearly a very heated situation and you have demonstrated remorse.”

He imposed a community payback order with two years’ supervision and ordered Banks to complete 120 hours of unpaid work.
